The manager of Capital Forex Bureau, who was convicted of embezzling sh26m, has filed an appeal challenging his conviction
Kenneth Wojega was found guilty and convicted by the Anti-Corruption Chief Magistrate’s Court on March 31 this year and ordered to refund the money.
Chief Magistrate Joan Aciro convicted Wojega and ordered him to compensate the forex bureau to the tune of sh26m.
On July 18, Wojega, through his lawyers, filed an appeal at the Anti-Corruption Division of the High Court in Kololo, Kampala, before Justice Lawrence Gidudu, asking the court to quash the conviction and sentence.
“The learned trial magistrate erred in law and fact when she failed to properly evaluate the evidence on record and came to the wrong conclusion that the appellant stole sh26m,” reads the appeal.
Wojega further argued that the magistrate was wrong to order him pay a compensation of sh26m without due regard to extenuating circumstances.
Magistrate Aciro convicted Wojega on grounds that the prosecution proved beyond doubt that the convict embezzled the money.
“I find that prosecution has proved its case beyond reasonable doubt that the accused without any claim of right fraudulently took money to the tune of sh26,023,879 belonging to the complainant (Capital Forex Bureau), which he had access to by virtue of his employment,” ruled Aciro in March.
The Anti-Corruption Court is yet to hear the appeal.
